§1. General Provisions
1 These Terms and Conditions define the rules for:
◦ booking spa and wellness services,
◦ making payments,
◦ cancellations and refunds,
◦ customer responsibilities,
◦ provision of electronic services via the Website.
2 The Service Provider is BALI ORGANIC Krzysztof Lisiecki
, operating under Polish law.
3 By booking an appointment or using services, the Client confirms that they have read and accepted these Terms.
4 A Client is:
◦ a natural person with full legal capacity,
◦ or a legal entity acting through an authorized representative.
If the Client is a consumer within the meaning of Polish law, mandatory consumer protection provisions apply.
§2. Scope of Services
The Company provides wellness and spa services, including but not limited to:
• Body massages
• Body scrubs
The detailed scope and prices are available on the Website or at the premises.
§3. Electronic Booking
1 Appointments may be made:
◦ via the Website,
◦ by phone,
◦ in person.
2 A booking is confirmed once:
◦ the Client receives confirmation via email/phone/SMS.
3 The Company may refuse a booking if:
◦ previous payments remain unpaid,
◦ the Client has repeatedly violated these Terms,
◦ service cannot be safely provided.
§4. Prices and Payments
1 All prices:
◦ are expressed in PLN (Polish złoty),
◦ include VAT (if applicable).
2 Accepted payment methods:
◦ cash,
◦ card payments,
◦ bank transfer,
◦ online payments,
◦ vouchers/gift cards.
§5. Refunds
There are no refunds on any of our services or any of our Vouchers/Gift Cards purchased on our website or in our facility. All sales are final.
§6. Cancellation and Rescheduling for Booked Appointments
1. Cancellation by the Client
• Cancellation must be made at least [24] hours before the appointment.
• There is no cancellation fee or loss of deposit (we don't require deposits) for no-show or late cancellation.
2. Cancellation by the Company
The Company may cancel or reschedule due to:
• force majeure,
• illness of staff,
• technical reasons.
In such case, the Client may:
• reschedule
§7. Consumer Right of Withdrawal (Distance Contracts)
If booking is made online (distance contract):
1 A consumer has the right to withdraw within 14 days from conclusion of the contract without giving reason.
2 However, pursuant to Article 38 of the Consumer Rights Act, the right of withdrawal does not apply if:
◦ the service concerns a specific date or period of performance (e.g., booked spa appointment).
3 If the Client expressly requests performance before expiry of the withdrawal period, they lose the right to withdraw once the service is fully performed.
§8. Health and Safety
1 The Client is obliged to inform the Company about:
◦ health conditions,
◦ pregnancy,
◦ allergies,
◦ skin conditions,
◦ medications,
◦ contraindications.
2 The Company may refuse service if:
◦ providing treatment may endanger health,
◦ the Client is under the influence of alcohol or drugs,
◦ inappropriate behavior occurs.
3 The Company is not liable for consequences resulting from failure to disclose relevant health information.
§9. Gift Cards and Packages
1 Gift cards:
◦ are non-refundable,
◦ valid for the period specified at purchase.
2 Unused services after expiration are forfeited unless mandatory consumer law provides otherwise.
3 Promotional offers cannot be combined unless explicitly stated.
§10. Complaints Procedure (Reklamacje)
1 Complaints may be submitted:
◦ via email,
◦ in writing at the business address.
2 A complaint should include:
◦ name and contact details,
◦ description of the issue,
◦ date of service.
3 The Company will respond within 14 days.
4 Consumers may use out-of-court dispute resolution methods, including:
◦ municipal consumer ombudsman,
◦ Trade Inspection
◦ EU ODR platform: https://ec.europa.eu/consumers/odr
§11. Liability
1 Services are provided with due care in accordance with professional standards.
2 Liability is limited to the value of the service provided, unless mandatory law provides otherwise.
3 The Company is not responsible for:
◦ loss of personal belongings,
◦ damage caused by failure to follow staff instructions.
§12. Personal Data (RODO / GDPR)
1 Personal data is processed in accordance with:
◦ Regulation (EU) 2016/679 (GDPR),
◦ Polish data protection law.
2 Detailed rules are described in the Privacy Policy available on the Website.
3 The Client has the right to:
◦ access data,
◦ rectify data,
◦ erase data,
◦ restrict processing,
◦ lodge a complaint with the President of the Personal Data Protection Office (UODO).
§13. Final Provisions
1 These Terms are governed by Polish law.
2 Any disputes shall be resolved by competent Polish courts.
3 The Company reserves the right to amend these Terms for important legal or operational reasons.
4 The current version is published on the Website.
